These Terms and Conditions govern your use of SamtHQ (samthq.com). By creating an account or using the platform, you agree to be bound by these terms. If you do not agree, do not use the service.

1. About SamtHQ

SamtHQ is an AI-powered pre-launch campaign intelligence platform operated by Faras Enoon, a sole trader registered in the United Kingdom. SamtHQ analyses marketing assets — including text, images, video, and audio — against cognitive science and behavioural psychology frameworks to provide diagnostic reports. The service is accessible at samthq.com. These Terms apply to all users including free tier users, paid subscribers, and any person accessing the platform on behalf of an organisation.

2. Definitions

"Service"The SamtHQ platform, including all software, features, APIs, and content provided through samthq.com.

"User" or "you"Any individual or entity that accesses or uses the Service.

"Content"Any text, images, video, audio, data, or other material you upload, submit, or transmit through the Service.

"Output"Any analysis, report, score, finding, or recommendation generated by the Service in response to your Content.

"Subscription"A paid plan (Starter, Agency, or Enterprise) granting enhanced access to the Service.

"We" / "SamtHQ"Faras Enoon, the operator of the Service.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years of age to use SamtHQ. By registering, you confirm you meet this requirement.

3.2 Account Accuracy

You agree to provide accurate, current, and complete information when creating your account and to update it promptly if it changes. You are responsible for all activity that occurs under your account.

3.3 Account Security

You are responsible for maintaining the confidentiality of your credentials. Notify us immediately at samthq10@gmail.com if you suspect unauthorised access. We are not liable for loss arising from your failure to protect your credentials.

3.4 One Account Per User

Each user may maintain only one account. Creating multiple accounts to circumvent plan limits, abuse free tier access, or manipulate usage counters is a material breach of these Terms and may result in immediate termination.

4. Permitted Use

4.1 Authorised Use

SamtHQ is a professional tool for marketing analysis. You may use the Service to analyse marketing materials for which you hold the necessary rights, and to generate reports for your own use or for clients you represent.

4.2 Prohibited Use

You must not use the Service to:

—Upload or analyse content you do not own or have the right to use
—Upload content that is unlawful, defamatory, obscene, or promotes violence or illegal activity
—Reverse engineer, scrape, or extract the underlying AI models, prompts, or analytical frameworks
—Use automated scripts or bots to submit requests in bulk without prior written consent
—Attempt to manipulate your subscription status, usage limits, or plan tier through any technical means
—Resell, sublicense, or white-label the raw Service infrastructure without an Enterprise agreement
—Damage, disable, or impair the platform or interfere with other users
—Access accounts, systems, or data belonging to other users
—Use the Service to train competing AI models or build datasets from the Service's outputs

5. Plans, Pricing, and Payment

5.1 Free Tier

The Free plan provides limited access at no cost, subject to usage limits displayed on the platform. Free tier limits may change with reasonable notice.

5.2 Paid Subscriptions

Paid plans are offered on a monthly or annual basis. All prices are stated exclusive of VAT unless otherwise indicated. VAT will be applied where required by law.

5.3 Payment Processing

Payments are processed by Stripe Inc. We do not store your payment card details. All payment data is handled directly by Stripe.

5.4 Billing Cycle

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.

5.5 Cancellation

You may cancel at any time through account settings or by emailing samthq10@gmail.com. Cancellation takes effect at the end of the current billing period. No partial refunds for unused portions.

5.6 Refunds

Payments are generally non-refundable except:

—10x Insight Guarantee: If your first analysis does not surface at least three missed psychological triggers, you are entitled to a full refund of your first month. Must be claimed within 14 days of your first analysis on a paid plan.
—Service unavailability: If the Service is substantially unavailable for more than 72 consecutive hours due to our fault, you may request a pro-rata credit.

5.7 Price Changes

We will give at least 30 days' notice of any price increase before it applies to your subscription.

6. Your Content

6.1 Ownership

You retain all intellectual property rights in the Content you upload. We claim no ownership over your Content.

6.2 Licence to Process

By uploading Content, you grant SamtHQ a limited, non-exclusive, royalty-free licence to process, transmit, and store your Content solely to deliver the Service. This licence ends when you delete the Content or close your account.

6.3 Content Warranties

You warrant that you own or have the necessary rights to all Content you upload, that it does not infringe third-party intellectual property, and that it is not unlawful or harmful. You agree to indemnify us against claims arising from breach of these warranties.

6.4 Content Storage

We do not guarantee indefinite storage. We may delete Content associated with inactive free accounts after 12 months of inactivity. We recommend downloading reports you wish to keep.

7. Our Outputs and Limitations

7.1 Nature of Analysis

Outputs are informational and advisory in nature. They represent probabilistic assessments based on cognitive science frameworks applied to your Content.

7.2 No Guarantee of Results

We do not guarantee that following any Output will result in improved marketing performance, increased conversions, or any specific business outcome.

7.3 Not Professional Advice

Outputs do not constitute professional marketing, legal, financial, or psychological advice. Exercise your own professional judgement before acting on any Output.

7.4 AI Limitations

AI models may occasionally produce inaccurate or inconsistent analyses. Treat Outputs as one input among several in your decision-making process.

8. Intellectual Property

8.1 SamtHQ Platform

All intellectual property in the Service — including software, analytical frameworks, scoring methodologies, interface design, and branding — belongs to SamtHQ.

8.2 Outputs

You may use, reproduce, and share Outputs for internal and client-facing purposes. You may not represent Outputs as your own proprietary analytical framework or use them to build a competing service.

8.3 Feedback

If you provide feedback or suggestions, you grant us the right to use that feedback without restriction or compensation.

9. Privacy and Data

Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Service, you agree to our Privacy Policy, which is incorporated into these Terms by reference.

10. Limitation of Liability

10.1 Exclusion of Consequential Loss

To the fullest extent permitted by law, SamtHQ is not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits, revenue, data, or reputational damage.

10.2 Cap on Liability

Our total liability to you is limited to the greater of: (a) total fees paid by you in the 12 months preceding the claim, or (b) £100.

10.3 Consumer Rights

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold harmless SamtHQ from any claims, liabilities, damages, and expenses arising from your breach of these Terms, your violation of any law or third-party rights, or your Content.

12. Termination

12.1 Termination by You

Close your account at any time by contacting samthq10@gmail.com. This cancels any active subscription at the end of the current billing period.

12.2 Termination by Us

We may suspend or terminate your account immediately for material breach, fraudulent activity, or use that causes harm to others. Full service termination will be preceded by 30 days' notice with pro-rata refunds for unused paid periods.

12.3 Effect of Termination

Upon termination, your access ceases immediately. We will delete your account data within 30 days, except where retention is required by law.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales. We encourage informal resolution by contacting samthq10@gmail.com before initiating formal proceedings.

14. Changes to These Terms

We will notify you of material changes at least 14 days before they take effect by email or prominent notice on the platform. Continued use after changes take effect constitutes acceptance.
